While the Covid-19 pandemic may feel like a distant memory to some, disputes about recovery of Covid-19 losses are very much front and center in the reinsurance industry. While majority of the U.S. courts have determined that there is no business interruption coverage under primary property policies for Covid-19 losses because the same do not present a physical loss of or damage to property, the non-U.S. courts have reached a different conclusion due to the different wordings of the primary policies in numerous foreign jurisdictions. The panelists present competing arguments whether Covid-19 was/was not a natural peril and will point to provisions that may be considered in answering this question.
