Indeed, even today many reinsurance agreements state as much explicitly and refer to the parties’ intent to honor the custom and practice of the insurance/reinsurance industry. But in a marketplace that has seen significant consolidation and new market entrants many companies find themselves dealing with a different counterparty years after the agreement is introduced. And technology, AI and big data are influencing decisions.
