This session will provide an overview of how generative AI functions, along with considerations that in-house and outside attorneys should be aware of before advising clients. Specifically, generative AI permanently retains data to generate results, and any outputs may contain fabricated information or errors. It can also be used on personal devices for free and without training, which could potentially introduce legal issues. Attorneys need to be mindful of their ethical duties to protect client data, provide competent representation, exercise independent judgment, and supervise AI use.
